1. Acceptance of Terms
By accessing or using the BASE-100 Institute website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
The BASE-100 Institute provides:
- Access to the BASE-100 Standard framework and documentation
- Self-audit tools for business maturity assessment
- Operator membership (free tier)
- Architect certification program (paid tier)
- Educational resources and governance participation
3. User Accounts and Registration
3.1 Account Creation
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Membership Tiers
4.1 Operator (Free Tier)
Free access to self-audit tools and basic features. No commercial use of audit results for third parties.
4.2 Architect (Professional Tier)
Annual fee of €450. Includes license to audit client organizations, voting rights, and conference access. Subject to entrance examination and annual renewal.
5. Intellectual Property
5.1 BASE-100 Standard
The BASE-100 Standard, including the 10x10 Matrix framework, domain definitions, and maturity levels, is the intellectual property of the BASE-100 Institute.
5.2 License Grant
Operators receive a non-exclusive, non-transferable license to use the Standard for internal business purposes only. Architects receive an additional license to conduct audits for third-party clients.
5.3 Restrictions
You may not modify, reproduce, distribute, or create derivative works based on the BASE-100 Standard without explicit written permission.
6. Payment and Refunds
Architect certification fees are non-refundable. Annual renewals are required to maintain certification status. Failure to renew will result in loss of Architect privileges.
7. User Conduct
You agree not to:
- Use the services for any unlawful purpose
- Misrepresent your certification status or audit results
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the services
- Share account credentials with others
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the services will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, the BASE-100 Institute shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the services after changes constitutes acceptance of the modified Terms.
